Greyhound hit with class action law suit by survivors of crash

four of the surviving passengers from the deadly bus crash that took place in New York including two from Montreal have filed a class action law suit against Greyhound. the lawsuit is alleging that Greyhound was negligient and that the bus driver fell asleep at the wheel. the suit also raises concerns about the condition of the bus and that the bus driver was wearing earphones from an i-pod or some other personal music player.

the crash killed five people, three of which were from quebec and one being the bus driver.

I wonder if they can prove the driver had an ipod on during the crash, and if there wasn't mechanical/tire failure. I just realized there was a bus crash CSI once where a tire failed, and their story was that the suspension was made to be faulty.

whether they can prove the driver had an ipod in or not shouldn't matter. an mp3 player or ipod isn't even as close to a distraction compared to crying babies, loud passengers, or drunk passengers. there is nothing wrong with listening to music from a personal music player in my opinion.

The driver using an ipod may not be an issue but I'm pretty sure that in most places it is illegal to drive with headphones on.
